Prize Draw Terms and Conditions

1 THE PROMOTER

The promoter is: WEATHERBEETA LIMITED, a company incorporated in England and Wales with company number 03006765 and registered address at Unit 5 Shipton Way, Express Business Park, Rushden, Northamptonshire, NN10 6GL, England (the "Promoter").

2 THE PRIZE DRAW

2.1 The title of the prize draw is as described on the relevant entry form for this prize draw, which can be located on the Promoter's website at www.weatherbeeta.co.uk (the "Entry Form").

3 HOW TO ENTER

3.1 The prize draw will run from the "Opening Date" until the "Closing Date" inclusive, the relevant dates and times applicable to the Opening and Closing Date(s) are outlined on the Entry Form.

3.2 All prize draw entries must be received by the Promoter by submitting a completed Entry Form on or before the Closing Date. All prize draw entries received after the Closing Date are automatically disqualified.

3.3 No purchase is necessary and there is no charge to register for use of the Promoter's website.

3.4 The Promoter will not accept responsibility for prize draw entries that are lost, mislaid, damaged or delayed, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.5 By submitting a prize draw entry, you are agreeing to be bound by these terms and conditions.

3.7 The prize draw entries that meet the criteria set out under clause 3.2 will be collated and a winner selected at random using a random number generator to select a winner at random.

4 ELIGIBILITY

4.1 The prize draw is only open to all residents in the UK aged 18 years or over, except:

(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the prize draw or its administration; or
(c) members of the immediate families or households of (a) and (b) above.

4.2 In entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the prize draw.

4.3 The Promoter will not accept prize draw entries that are:

(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) illegible, have been altered, reconstructed, forged or tampered with; or
(d) incomplete.

4.4 Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw.

5 THE PRIZE

5.1 The prize, or prizes (where relevant) are described on the Entry Form.

5.2 Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.

5.3 The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.

5.4 The prize is not negotiable or transferable.

6 WINNERS
6.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.

6.2 The Promoter will contact the winner personally as soon as practicable after the "Announcement Date" (as stipulated in the Entry Form), using the email address or other contact details provided by the entrant on the completed Entry Form.

6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners on the Website and/or any of the Promoter's social media pages and may send the surname and county of
major prize winners, to anyone who emails info@weatherbeeta.co.uk within one month after the Closing Date of the prize draw.

6.4 If you object to any or all of your surname or county being published or made available, please contact the Promoter by emailing info@weatherbeeta.co.uk. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7 CLAIMING THE PRIZE

7.1 If you are the winner of the prize, you will have 28 days from the Announcement Date to claim the prize by responding to the Promoter's email or other communication and, where applicable, arrange to take delivery within 40 days of the Announcement Date. If you do not claim the prize by this date, your claim will become invalid.

7.2 The prize may not be claimed by a third party on your behalf.

7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 28 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize within the timescales set out under clause 7.1, or otherwise.

8 LIMITATION OF LIABILITY
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9 DATA PROTECTION AND PUBLICITY

9.1 The Promoter will only process your personal information in accordance with the relevant data protection laws (including the General Data Protection Regulation (EU) 2016/679 and the Data Protection Act 2018) and as set out in the Promoter's privacy notice which is available at www.weatherbeeta.co.uk/privacy-policy. See also condition 6.3 and condition 6.4, with regard to the announcement of winners.

9.2 By participating in this prize draw, each entrant agrees to allow the Promoter the right to use his/her name, likeness, picture and other information and content provided in connection with the prize draw for promotion, trade, commercial, advertising and publicity purposes in all media worldwide including, but not limited to, on television and the Internet, without notice, review or approval and without additional compensation during a maximum period of two (2) years.

10 GENERAL

10.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.

10.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize prize draw where it becomes necessary to do so.

10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

10.4 We do not accept sharing on “exchange for likes” pages/groups, and likewise, do not accept self-promotion, competitions, or "calling" for likes in order to boost a post's entry or total likes. If anyone who has entered the giveaway is seen to share on these types of pages/groups, they will be disqualified from the giveaway. This decision is at the discretion of the Marketing Team at Weatherbeeta Ltd.
